Those under 18 years old who wish to participate in volunteer activities must have a Parental Consent Form submitted to a Kitty Devore Rescue administrator in writing that verifies consent and adherence to each statement outlined in this agreement.* I understand I don't understand If I have an issue with any aspect of Kitty Devore Rescue policy, procedure, decisions or determinations as they relate to the area of my volunteer service, I understand I am to present the issue or concern to the attention of Kitty Devore Rescue’s administrators, Renée Mc Elwee or Lauren Brandt, either verbally or in writing.* I understand I don't understand I understand discussions with other Kitty Devore Rescue members about problems, concerns or issues is fine, as long as doing so does not undermine the functionality, harmony and cohesion of the rescue group.* I understand I don't understand I understand undermining Kitty Devore Rescue and Kitty Devore Rescue Network’s group functionality, harmony and cohesion can result in dismissal from the group network, removal from the rescue team and termination of my volunteer services. If 3 or more members privately and individually contact the administrators to complain about another members’ activities or conduct as it relates to Kitty Devore Rescue and Kitty Devore Rescue Network, the membership of that individual will be taken up for review by the Kitty Devore Rescue Board. If just cause for dismissal cannot be found, the volunteer member will not be dismissed but may be informed that they have been the cause of alarm or concern among members of the rescue group and that they may wish to reevaluate their conduct or behavior. However, if just cause can be found, the volunteer member in question will be informed of the Board’s decision to remove them from the group network, rescue membership and they will subsequently be dismissed and volunteer services terminated.* I understand I don't understand I understand guilt-tripping, name calling, pressuring another member, bullying and other dysfunctional and/or disrespectful behavior will not be tolerated on the group network or when carrying out volunteer service for Kitty Devore Rescue. The first instance will result in a warning. The second occurrence will result in dismissal from the network and rescue team and volunteer services terminated.* I understand I don't understand I understand inactivity on the group network beyond two months is subject to removal from the network. Members who are removed for this reason can petition an administrator for reinstatement.* I understand I don't understand I understand there are occasions where profanity is the only way to express what one is feeling in the life or death situations we face daily in the Kitty Devore Rescue group network forum. I understand using profanity to express what I or others are feeling in a comment in the group forum about a given situation is acceptable and there are no penalties or consequences for doing so. However, using profanity as an insult or pejorative directed at another member is not acceptable. I also understand it is expected I will refrain from using profanity when carrying out volunteer services at adoption venues or other duties where professionalism as a representative of Kitty Devore Rescue is required.* I understand I don't understand I understand the closed group network is the forum to voice anything about Devore Animal Shelter that we may find questionable or disconcerting however, it is the ONLY forum where volunteer members are permitted to do this. We strive to maintain an amicable relationship with the shelter and this is our public stance, irrespective of what we may feel privately. On Kitty Devore Rescue’s external social media forums, adoption event venues and public meetings members may attend that involve shelter staff or shelter issues - the goal is to always remain amicable, maintain a stance that we work in cooperation with the shelter to successfully carry out or rescue work and any feedback must always be solution oriented. Members who write or speak about the shelter in negative terms are discouraged from mentioning their affiliation with Kitty Devore if they choose to do so as this works against our goals and agenda and is not helpful to us or the cats we strive to save.* I understand I don't understand I understand focus in the group network forum must stay strictly on the cats currently admitted to Devore Shelter or Kitty Devore Rescue business and topics of discussion or that of our rescue partners and their foster cats as they relate to Devore and the Kitty Devore Network as a whole. Posts about cats from other shelters are not permitted. Posts from non-Kitty Devore Rescue partner rescue groups are not permitted. Posts about cats belonging to a friend who has no connection to San Bernardino county or Devore shelter are also not permitted. I understand occasionally allowances will be made in special circumstances. If I have information I’d like to share with the overall membership and feel would be beneficial for the network as a whole or a circumstance or situation is especially important to me, I will present the information to Kitty Devore Rescue administrators in writing first for consideration and approval before posting it to the network group forum. If this is not done, the post may be removed and administrators are under no obligation to inform me prior to it’s removal. This is not a punitive measure. It is done to maintain focus and minimize distractions on matters that are not directly related to Kitty Devore Rescue, our rescue partner rescue groups or Devore Shelter.* I understand I don't understand I understand in the event a Kitty Devore Rescue foster parent or volunteer member contacts a Kitty Devore Rescue administrator to convey their decision to withdraw from their fostering or volunteer commitment and contract with the rescue, unless specific arrangements are discussed, the member will be immediately removed from the group forum. Arrangements regarding continued foster care obligations in lieu of new placements for the foster cats in the member’s care and relinquishment of the cats back into the care of the rescue or finalization of volunteer commitments will be carried out either via Facebook private message, email or phone. Members who opt to leave active Kitty Devore Rescue foster care commitments and who are removed from the network group forum but who also have obligations to and commitment agreements with KD rescue partners will need discuss their specific situations with those rescue partners via Facebook private message, email or phone.* I understand I don't understand I understand that, in the event of contention between Kitty Devore Rescue members who find themselves at odds or feel their membership in the network group or adoption venue forum is cause for personal discomfort or stress for themselves or others, they have the right and obligation to contact a Kitty Devore Rescue administrator to explain the situation and express their desire to leave the group or amend/adjust their volunteer commitment obligations or schedule but still remain a Kitty Devore Rescue volunteer. I understand each individual situation will vary and the terms of each situation will remain confidential between the Kitty Devore Rescue Board and the individual Kitty Devore Rescue foster/volunteer member.* I understand I don't understand I understand I may not publicly or privately solicit other Kitty Devore Rescue members for money to purchase personal items or request personal financial assistance. Should an occurrence of this nature with supportive proof reach the attention of a Kitty Devore Rescue Board member, the member who has solicited funding for personal reasons will be contacted and warned. The second occurrence will result in dismissal from the network and rescue team and volunteer services terminated.* I understand I don't understand I understand solicitation for funding for other groups or causes that are not relative to Kitty Devore Rescue requires the approval of the Kitty Devore Rescue Board before the appeal can be posted to the group network or the public Kitty Devore Rescue Facebook page. This includes fundraising efforts for indie rescued cats by Kitty Devore Rescue members, KDSDA cats belonging to Kitty Devore Rescue members and fundraising for rescue partner group causes. I understand if a post of this nature is posted to the network, it will be removed. Solicitation for funding for other groups, non-Kitty Devore Rescue causes, indie rescues, KDSDA rescues and rescue partner fundraisers are encouraged for personal pages and rescue partner pages and websites.* I understand I don't understand I understand Kitty Devore Rescue Network members may not block other members of the team in the group forum on Facebook. Open lines of communication are imperative in the work we do together. Blocking creates a break down of communication. In a forum where information is constantly being exchanged, blocking other members from seeing your posts or vice/versa creates dysfunction in the group and is willfully and intentionally disruptive to group cohesion and harmony. If it is discovered a member has blocked another member, the member who has done the blocking may be removed from the network. They may petition to return but, in order to do so, they must unblock whomever they have blocked and re-establish open lines of communication on the network again.* I understand I don't understand I understand that, as a volunteer, if I volunteer my time and service as a Kitty Devore puller, I can only be considered for this duty after 90 days have elapsed from the date of approval of this application and agreement. I understand I must also sign and submit either the Work for Hire Puller Agreement form and W9 forms or the Waiver of Work for Hire Puller Agreement form in order to become an approved puller for Kitty Devore Rescue. I understand if I choose the Work for Hire agreement, I will be compensated $25.00 per day to cover my time, gas expenses and postage expenses for submitting shelter paperwork each time I pull cats from Devore Shelter on behalf of Kitty Devore Rescue. I understand that this amount will be remitted to me within 7 days of the pull. I understand that the amount I am compensated is taxable and I will receive a 1099 form in January if the overall dollar amount exceeds $600 in a given year and that anything under $600 is tax free.* I understand I don't understand I understand that, as a volunteer, if I use my personal vehicle in service to Kitty Devore Rescue to transport, I am to coordinate this in advance with Kitty Devore Rescue’s transport officer. I understand that my vehicle must registered and be personally insured and the insurance policy current. I understand, if arranged in advance with the transport officer, I am afforded reimbursement for gas expenses if a receipt is submitted and I am also afforded a reimbursement of the charity milage rate of .14 cents per mile if screenshots of miles driven are submitted. I understand that the amount I am compensated is taxable and I will receive a 1099 form in January if the overall dollar amount exceeds $600 in a given year and that anything under $600 is tax free.* I understand I don't understand I understand that if I volunteer to work at an adoption event headed by a Kitty Devore Rescue administrator, Board member or Adoption Event Manager, I will defer to their authority and directives as they pertain to adoption event conduct, procedure and policy.* I understand I don't understand I understand if I have an interest in fostering, I must complete and submit the Kitty Devore Rescue Foster Application and Agreement before I can be considered as a Kitty Devore Rescue foster parent. If I am interested in adopting, I understand that I must complete and submit the Kitty Devore Rescue Adoption Application. Both are subject to approval by a Kitty Devore Rescue foster or adoption officer and a home check will be required before fostering or adopting can take place.* I understand I don't understand I understand that there are no monthly dues required of me as a member of the Kitty Devore Rescue or Kitty Devore Rescue Network.* I understand I don't understand Liability Release and Waiver:I understand that the scope of my relationship with Kitty Devore Rescue is limited to a volunteer position and that no compensation is expected in return for services provided by me; that Kitty Devore Rescue will not provide any benefits traditionally associated with employment to me, and that I am responsible for my own insurance coverage in the event of personal injury or illness as a result of my services to Kitty Devore Rescue.* I understand I don't understand I release and forever discharge and hold harmless Kitty Devore Rescue from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide to Kitty Devore Rescue. I release and forever discharge Kitty Devore Rescue from all liability for any causes of action or suits of any kind whatsoever, and particularly on account of any injuries, to person or property sustained while fostering, pulling cats from the shelter, transporting cats, attending adoption events or performing other services, voluntary or otherwise, on behalf of, or in conjunction with, Kitty Devore Rescue.* I understand I don't understand I understand and acknowledge that this release discharges Kitty Devore Rescue and each of its administrators, officers, members and agents from any liability or claim that I may have against them with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to them or occurring while I am providing volunteer services.* I understand I don't understand I agree to immediately report all injuries or disease I may receive while working in the service of Kitty Devore Rescue, including but not limited to animal bites and deep scratches, to Kitty Devore Rescue administrators, Renée Mc Elwee and Lauren Brandt, within 24 hours of the incident and inform them of said incident.* I Agree I Do Not Agree I understand that Kitty Devore Rescue does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance - other than that which is outlined in this agreement with respect to authorized pullers and transporters. I expressly waive any such claim for compensation or liability on the part of Kitty Devore Rescue beyond what may be offered freely by them in the event of injury or medical expenses incurred by me.* I understand I don't understand I further agree that if, despite this release of liability and hold harmless agreement clause, I or anyone on my behalf makes a claim against Kitty Devore Rescue, I will indemnify, save and hold harmless Kitty Devore Rescue from any damages, losses and expenses including, but not limited to, legal fees, courts costs, and litigation expenses.* I Agree I Do Not Agree I release and forever discharge Kitty Devore Rescue, a nonprofit corporation organized and existing under the laws of the State of California and each of its administrators, officers, members and agents from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer with them.* I understand I don't understand I agree to indemnify and hold harmless Kitty Devore Rescue from any and all liability, damage, loss, cost and expense incurred as a result of any claim, demand or cause of action brought against Kitty Devore Rescue, jointly or individually, for bodily injury, death or property damage suffered as a result of my own negligent, reckless or willful act, omission in the performance or failure to perform my volunteer services. I further acknowledge and agree that I: (a) fully understand the meaning of this Release and Waiver clause and recognize my right to seek the advice of an attorney before signing it; (b) have signed it freely and without any inducement or assurance of any nature; (c) intend it to be a complete unconditional release of liability to the greatest extent allowed by law; and (d) agree that if any portion of this agreement is held to be invalid the balance notwithstanding shall continue in full force and effect. The acceptance of this release shall not operate as an admission of liability on the part of anyone, nor as a waiver or bar with respect to any claim that I may have against the undersigned.* I Agree I Do Not Agree As a volunteer, I hereby expressly assume risk of injury or harm while providing volunteer service and release Kitty Devore Rescue from all liability.* I understand I don't understand I grant and convey to Kitty Devore Rescue all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by the rescue in connection with my providing volunteer services to them.* I grant I don't grant As a volunteer, I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this release shall not be affected.* I agree I don't agree I understand that because the provisions of this agreement are legally binding, any violation of this agreement could result in legal liabilities for myself and Kitty Devore Rescue.* I Agree I Do Not Agree I agree that all the information I have provided in this volunteer membership application is true. Should it be found the information I have provided in this application is untrue prior to approval, it may result in a denial of the application.
